The subject of this Agreement is to set out the rights and obligations of the parties regarding the sale and performance of the service, whose characteristics and sale price are specified below, ordered electronically by the BUYER through the SELLER’s higgstour.com website.
The services offered for sale are bus rental, minibus rental, airport transfer and hotel booking intermediary services.

The type, route, date, time, vehicle class, passenger capacity and VAT-inclusive sale price of the service are shown in detail in the booking steps and in the booking confirmation email. This information forms an integral part of this Agreement.
Payment can be made through the Site by credit/debit card, or by bank transfer/EFT to the bank account provided by the SELLER.
Under Article 15/1-g of the Distance Contracts Regulation, “contracts for accommodation, transportation of goods, car rental, food and beverage supply, and leisure activities for entertainment or recreation that must be performed on a specific date or within a specific period” are among the exceptions to the right of withdrawal.
Therefore, there is no 14-day statutory right of withdrawal for vehicle rental, transfer and accommodation services purchased through the Site. By confirming the order, the BUYER declares that they accept this.
Although there is no statutory right of withdrawal, the SELLER applies a cancellation and refund policy at its own initiative for customer satisfaction. The terms are set out in Article 7 of this Agreement and on the Delivery and Return Policy page.
The SELLER’s cancellation and refund policy is tiered according to the time remaining before the scheduled start of the service:

Natural disasters, states of emergency, epidemics, war, terrorist incidents, strikes, general transport restrictions, road closures, severe weather conditions, decisions of official authorities and similar circumstances beyond the control of the parties that make performance of the agreement impossible are deemed force majeure.
In the event of force majeure, the parties cannot be held responsible for failing to fulfil their obligations. The SELLER will notify the BUYER immediately; the BUYER may either postpone the service to a later date free of charge or terminate the agreement and receive a refund of the full amount paid.
If the BUYER defaults on payments made by credit card, the cardholder accepts that they will be liable to the bank under the credit card agreement between themselves and the bank. In this case, the bank may take legal action and claim the resulting costs and attorney’s fees from the BUYER.
If the BUYER defaults on their debt, the SELLER reserves the right to claim from the BUYER compensation for any loss and damage arising in the collection of its receivable.
The SELLER processes and protects the BUYER’s personal data in accordance with Turkish Personal Data Protection Law No. 6698. For details, please see the Privacy Policy and KVKK Privacy Notice page.
